Terms and Conditions (AGB)

1. Scope

These Terms and Conditions apply to all deliveries made by La Perla Gems to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the button [Buy / Place Order with Obligation to Pay], you place a binding order for the items listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with statutory provisions.

If you exercise your right of withdrawal as a consumer according to Section 4.1, you must bear the regular costs of returning the goods.

Otherwise, the rules set out in detail in the following Instructions on Withdrawal apply to the right of withdrawal.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post or an email) about your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery type other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.

You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

The prices stated on the product pages include statutory VAT and other price components.
In addition to the stated prices, we charge shipping costs. The exact shipping costs will be clearly communicated to you in the shopping cart system and on the order page.

6. Delivery

Delivery is made within Germany and to selected EU countries.
The delivery time for Germany is approx. 5–10 business days and for EU countries approx. 7–15 business days. Any differing delivery times will be indicated on the respective product page.

7. Payment

Payment can be made via Shop Pay, Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay, Klarna, or PayPal.
When choosing a payment method via an external payment service provider (e.g., PayPal, Klarna, Apple Pay, Google Pay), their respective terms of use and general terms apply in addition.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Warranty

La Perla Gems is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB).
An additional guarantee only applies to goods supplied if expressly stated in the order confirmation for the respective item.
